These Terms of Service ("Terms") govern your access to and use of FixAhead (the "Service"), operated by FixAhead ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

FixAhead is a computerized maintenance management system (CMMS) that provides asset tracking, work order management, preventive maintenance scheduling, issue reporting, inventory management, and reporting tools. The Service is available via web application and mobile applications.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at team@fixahead.com if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Upload malicious code, viruses, or harmful data
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or redistribute the Service without written permission

5. Data Ownership

You retain all rights to data you submit to the Service ("Your Data"). You grant us a limited license to use Your Data solely to provide and improve the Service. We will not sell, share, or use Your Data for purposes unrelated to the Service.

6. Subscription and Payment

Certain features require a paid subscription. Pricing, billing cycles, and plan details are available on our pricing page. Subscriptions renew automatically unless cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period.

We reserve the right to modify pricing with 30 days' advance notice. Price changes do not apply to the current billing period.

7. Free Plan

The free plan is available indefinitely with the limitations described on our pricing page. We reserve the right to modify free plan features with reasonable notice.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by factors beyond our reasonable control.

9. Data Security

We implement industry-standard security measures to protect Your Data. However, no system is completely secure. You are responsible for maintaining the security of your account credentials. Our data handling practices are described in our Privacy Policy.

10. Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by FixAhead and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.

11. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. Upon termination, your right to use the Service ceases immediately. You may request export of Your Data within 30 days of termination.

12. Limitation of Liability

To the maximum extent permitted by law, FixAhead shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Indemnification

You agree to indemnify and hold harmless FixAhead from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or notice within the Service. Continued use after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Chennai, Tamil Nadu, India.
